Penalties for a First DUI/DWI Offense

For a first DUI or DWI conviction, all offenders will face up to 30 days in jail, expensive hikes in insurance hikes, and up to 48 hours in an Intoxicated Driver Resource Center. Additional penalties will vary depending on the level of blood alcohol concentration (BAC) registered at the time of arrest.

For a BAC of .08% to .10%:

  • Up to $400 in fines
  • License suspension for three months
  • Possible ignition interlock device usage for up to a year

If you register a BAC exceeding .10%:

  • Fines up to $500
  • License suspension for up to one year
  • mandatory ignition interlock device usage for up to a year

Refusing to take a breath test can exacerbate the situation even further, automatically imposing additional fines and license suspension time. New Jersey has an implied consent law, meaning that by simply holding a driver’s license a person is in essence consenting to any breath test that an officer should request.
