How Likely is Jail Time For a First DUI in New Jersey? 

For a first DUI or DWI conviction, all offenders will face up to 30 days in jail, expensive hikes in insurance hikes, and up to 48 hours in an Intoxicated Driver Resource Center. Additional penalties will vary depending on the level of blood alcohol concentration (BAC) registered at the time of the arrest.

If an individual's BAC is found to be 0.08% or higher, they may face the following penalties:

  • A fine of up to $400
  • Suspension of their driver's license for three months
  • Completion of an alcohol education and highway safety program

If an individual's BAC is found to be 0.10% or higher, they may face the following additional penalties:

  • A fine of up to $500
  • Suspension of their driver's license for a period of seven to 12 months
  • Installation of an ignition interlock device (IID) in their vehicle

If an individual's BAC is found to be 0.15% or higher, they may face the following additional penalties:

  • A fine of up to $1,000
  • Suspension of their driver's license for a period of one to two years
  • Up to 30 days in jail
