How New Jersey Treats Postnuptial Agreements

New Jersey doesn’t have a specific statute governing postnuptial agreements the way it does for prenuptial agreements. A 2013 legislative amendment gave prenuptial agreements a presumption of enforceability, but that presumption doesn’t extend to postnuptial agreements. Mid-marriage agreements are therefore harder to enforce and face closer judicial review. Because spouses owe each other fiduciary duties once they’re married, courts look closely at whether both parties provided full financial disclosure, signed without coercion, and had a meaningful opportunity to obtain independent legal advice. An agreement that skips any of these steps is vulnerable to challenge.

The leading case is Pacelli v. Pacelli (1999), a case of first impression in New Jersey. The appellate court established what is now known as the dual-fairness standard: a postnuptial agreement must be fair and equitable both at the time it was signed and at the time a party seeks to enforce it. In Pacelli, the court refused to enforce the agreement because the husband’s ultimatum was found inherently coercive. Steele v. Steele (2021) reaffirmed that same dual-fairness standard, confirming it remains the governing test in New Jersey today.

Mid-Marriage Agreements vs. Reconciliation Agreements

New Jersey courts draw a meaningful distinction between two types of agreements. A mid-marriage agreement is made while the marriage is otherwise intact. A reconciliation agreement is made once a marriage has genuinely broken down and divorce or separation is imminent. Courts apply the stricter Pacelli standard to mid-marriage agreements and are generally more willing to enforce reconciliation agreements if they are fair on their face. A dispute over enforceability arising from a Monmouth County divorce would be heard in the Family Division of the Superior Court in Freehold.

What a Postnuptial Agreement Can Cover

A well-drafted postnuptial agreement can address a range of financial matters. Courts will evaluate whether the agreement as a whole is fair and equitable, so every provision matters.

Common subjects include:

• Property division: How marital and separate property will be classified and divided under equitable distribution principles
• Debt allocation: Which spouse bears responsibility for existing or future debts
• Business interests: How an ownership interest in a business will be treated
• Alimony: Whether spousal support will be paid, and in what amount or duration, though these terms face the same fairness scrutiny as the rest of the agreement

Child custody and parenting time can’t be locked in by a private agreement between spouses. New Jersey courts decide those issues based on the best interests of the child at the time the question arises, independent of any financial terms the parents previously agreed to. An agreement that attempts to predetermine custody carries little weight and won’t bind the court.

Enforceability Standards in New Jersey

Because the dual-fairness standard asks a court to evaluate circumstances at two separate points in time, how an agreement is drafted and what the process looked like matter as much as what the agreement says. Independent legal counsel isn’t strictly required, but it significantly strengthens the agreement if it’s later challenged.
