What a New Jersey Prenuptial Agreement Can Cover

Under N.J.S.A. 37:2-34, the scope of a valid prenuptial agreement is broad. Couples can use one to address nearly any financial matter before the wedding.

Commonly addressed topics include:

  • Division of premarital assets and debts acquired before and during the marriage
  • Spousal support and alimony, including a waiver, a cap, or a minimum amount
  • Business interests and how they’re treated if the marriage dissolves
  • Separate property designations for inherited or gifted assets
  • Inheritance rights and provisions protecting children from prior relationships
  • Sunset clauses that specify a date when the agreement’s terms expire

One limit worth understanding: a prenuptial agreement can’t govern child custody or child support. Courts determine those matters based on the best interests of the child at the time the issue arises, regardless of what any prior agreement says. Without a prenuptial agreement, New Jersey’s equitable distribution statute controls how marital property is divided at divorce, which may not reflect what either party actually wanted.
