New Jersey Grandparents’ Rights Law: What the Statute Requires

New Jersey’s grandparent visitation statute, N.J.S.A. 9:2-7.1, allows a grandparent of a child residing in New Jersey to apply to the Superior Court for a visitation order. The grandparent carries the burden of proving, by a preponderance of the evidence (meaning more likely than not), that granting visitation serves the child’s best interests. That standard sounds straightforward, but two court decisions have made it significantly more demanding.

The Constitutional Limitation: Troxel v. Granville

In Troxel v. Granville (530 U.S. 57, 2000), the U.S. Supreme Court held that a fit parent’s decision to limit third-party visitation carries constitutional weight. A best-interests showing alone isn’t enough when a parent objects. New Jersey applied that principle in Moriarty v. Brandt (177 N.J. 84, 2003), where the state Supreme Court established a threshold harm standard: a grandparent must first demonstrate that denying visitation would cause the child harm. Only after that threshold is met does the court conduct the full statutory best-interests analysis.

Exceptions Worth Knowing

If a grandparent has previously served as a full-time caretaker for the child, that history constitutes prima facie evidence (presumed sufficient on its face) that visitation is in the child’s best interests. Adoption by a non-stepparent, however, generally terminates a grandparent’s visitation rights entirely.

The Eight Factors New Jersey Courts Weigh

Once a grandparent meets the threshold harm standard, the court evaluates the petition against eight statutory factors. Understanding these factors determines what evidence you need to build your case.

The statutory factors cover:

• The existing relationship between the child and the grandparent
• The relationship between the grandparent and each parent or primary caretaker
• How much time has elapsed since the child last had contact with the grandparent

• Any history of physical, emotional, or sexual abuse or neglect by the grandparent

Courts have been clear that vague assertions about a lost loving relationship aren’t sufficient. A grandparent must show specific ways the child would be harmed if visitation is denied. In some cases, that requires expert testimony about the psychological or emotional impact of a severed grandparent-grandchild relationship.

Filing a Grandparent Visitation Petition in Monmouth County
