New Jersey’s Prevention of Domestic Violence Act

New Jersey’s Prevention of Domestic Violence Act (PDVA), codified at N.J. Stat. § 2C:25-17, et seq., has governed domestic violence cases in this state since 1991. It defines both who qualifies for protection and what acts can trigger a restraining order.

Not every conflict between people who know each other falls under the PDVA. The law covers specific qualifying relationships:

Current or former spouses
People who live together or have lived together
Individuals who share a child in common
Current or former dating partners

The act that prompted the complaint also has to qualify as a predicate act under the PDVA. Predicate acts include assault, harassment, terroristic threats, criminal restraint, stalking, sexual assault, criminal mischief, burglary, and any other crime involving a risk of death or serious bodily injury. A single qualifying act is enough for a court to issue a TRO.
